1. Introduction
Welcome to FlatLuxPick! These Terms of Service govern the use of our services, programs, and offerings in the field of professional luxury apartment selection and property consulting. By booking an appointment or using our services, you agree to these terms and commit to fully comply with them.
2. Service Eligibility
2.1. Client Information – Our services are available to individuals and businesses who need luxury apartment selection and property consulting services. During appointment scheduling, we request information about your housing requirements to ensure appropriate support.
2.2. Registration – Our services require prior registration and confirmation by FlatLuxPick. You are obligated to provide correct and current information.
2.3. Conduct Guidelines – During our consultations and interactions, we expect professional behavior. Any form of discrimination, disruptive behavior, or inappropriate communication may result in termination of services.
2.4. Confidentiality – Clients commit to maintaining the confidentiality of personal information shared during our luxury apartment selection sessions.
3. Appointment Booking and Payment
3.1. Service Bookings – Bookings can be made through our website, by phone, or in person and are binding upon our written confirmation.
3.2. Payment Terms – Service fees are due at the time of property consultation or after completion of apartment selection services. We accept bank transfers, major credit cards, and debit cards.
3.3. Business Invoices – For bookings by companies requiring comprehensive luxury apartment selection services, separate payment terms may be agreed upon as specified in the respective contract.
3.4. Cancellation Terms – For cancellations up to 48 hours before a scheduled appointment, no fee is charged. For cancellations within 48 hours, a cancellation fee of CHF 300 may apply. For no-shows, the full appointment fee is charged.
4. Service Provision and Changes
4.1. Service Planning and Execution –
- FlatLuxPick reserves the right to change the availability of services, times, and property consulting experts.
- In case of unavailability of certain luxury apartment selection services, an appointment may be rescheduled.
- Changes to appointments will be communicated to clients as early as possible.
4.2. Service Materials – All prepared property recommendations, apartment documentation, and digital records are processed according to legal requirements. We maintain records of created property documents as legally required, but the originals and copies provided to clients belong to the clients themselves.
5. On-Site Consultation Services and Special Requests
5.1. Registration – For on-site luxury apartment consultation services and special appointment requests, separate registration conditions apply that are communicated before booking and are binding.
5.2. Cancellation Terms – Cancellations for on-site consultation services must be made at least 72 hours in advance to receive a full refund. For later cancellations, a fee of CHF 500 will be retained.
5.3. Service Limitations – For certain specialized luxury apartment selection services, we reserve the right to refuse service due to legal restrictions, property market concerns, or jurisdictional limitations.
6. Liability Disclaimer and Warranty
6.1. Liability – FlatLuxPick is liable only in cases of intent or gross negligence by our employees or property consulting experts. We assume no liability for the content or legal validity of documents created by clients or third parties.
6.2. Professional Responsibility – Our property consultants review the accuracy and completeness of provided information but do not verify the content or legality of documents submitted for property consultation. Clients are responsible for the accuracy and legality of their documents.
7. Property and Premises
7.1. Use of Premises – Our offices and consultation rooms are to be treated with care. The responsible party is liable for intentional damages.
7.2. Valuables – We assume no liability for personal items and valuables left in our premises. Lockable storage options are available upon request.
8. Data Protection
8.1. Data Processing – The processing of personal data is carried out according to our separate privacy policy, which is considered an essential part of these Terms of Service and should be read carefully.
8.2. Property Documents – We maintain legally required records of created property documents. These records are kept confidentially and securely in accordance with data protection regulations.
9. Return Policy
9.1. Service Satisfaction – At FlatLuxPick, we strive to provide high-quality luxury apartment selection services. If you are not completely satisfied with the property consulting service received, please notify us within 7 business days after service delivery.
9.2. Refund Eligibility – Refunds or service credits may be granted at our discretion if:
- An error occurred in the property consulting process attributable to our consultant
- The apartment selection recommendation was unsuitable due to an error in our consultation
- The service was not provided as described or promised
- Property consultation advice proved incorrect due to lack of expertise on our part
9.3. Refund Process – To request a refund or service adjustment, please contact our customer service team in writing with details of your concerns and any supporting evidence. We will review each case individually and respond within 7 business days.
9.4. Limitations – Please note that refunds may not be available for:
- Luxury apartment selection services that were already fully provided according to standard consultation procedures
- Circumstances where the client did not provide complete or accurate property requirements or information
- Requests made more than 30 days after service delivery
- Rejection of apartment applications by landlords due to content issues unrelated to the property consultation itself
- Changes in property market conditions after service delivery
9.5. Alternative Solutions – In some cases, we may offer re-consultation services, a different property consulting expert, or a partial credit instead of a full refund, depending on the nature of the concern.
9.6. Satisfaction Guarantee – For justified complaints regarding our luxury apartment selection services, we grant a refund under certain circumstances. This applies particularly to demonstrable errors in property consultation that have led to financial disadvantages for the client. The refund is made after individual review of each case and can amount to up to 100% of the paid consultation fee, provided the error is clearly attributable to our fault and is claimed within the legal warranty periods.
10. Final Provisions
10.1. Severability Clause – Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions remains unaffected.
10.2. Applicable Law – These Terms of Service are subject to Swiss law. The place of jurisdiction for all disputes is the seat of FlatLuxPick, insofar as legally permissible.
